TERMS OF SERVICE

High 5 Promotions Provides Virtual Marketing Director Services for Micro, Small, and Medium Sized Businesses
These Terms and Conditions shall govern the relationship between High 5 Promotions and Client. The parties to this Agreement are independent contractors, and no agency partnership is intended or created by this Agreement.

By paying the invoice, the Client:
1. Is acknowledging that it has read and agrees to the High 5 Promotions “Terms and Conditions” which can be accessed at https://high5seo.agency/terms/
2. Is agreeing that payment in full is required for the first Campaign Cycle before the campaign will be scheduled to go live. Client shall pay in advance all amounts owed to High 5 for each subsequent Campaign Cycle.
3. Acknowledges and agrees that delivery of the services shall be conclusively evidenced by the reporting provided by the publisher’s data.
4. Acknowledges and agrees that the Client may cancel or terminate the agreement, as set forth in the “Terms and Conditions”.

Prior to starting the campaign, both parties will agree to a media budget. As Marketing Director, we will allocate that budget to the channel(s) that are delivering the most quality traffic – based on publisher analytics.

As Marketing Directors, any online channels that we create are assets for the Client. We act as stewards of the company data. We will allocate the agreed upon media budget. We will host meetings with advertising and marketing contractors. We will manage services such as Search Engine Optimization, Custom Text, Image, and Video Ad Content Creation, Allocate Credits Provided by Publishers, Search Ads, Display, Remarketing, Tracking Services, Chat Applications, Video Marketing, Online Reputation Management, Geotargeting, 3rd Party Directory Oversight, and Ensure Company Data is Provided to Necessary Parties. To diagnose campaign performance, we may track and record phone calls. All such recordings shall comply with applicable laws and regulations. In some cases, HIPPA limits our ability to record Client calls.

Campaign Cycles. Each Campaign Period consists of Campaign Cycles. The Campaign Cycle is the period-of-time from High 5 Promotion’s commencement of applying the Campaign Media until such time as no less than 98% of the Media Budget has been utilized. On average, this is approximately a 30-day period. Typically, these campaignsare operated on 3rd party sites that can choose to pause or accelerate campaigns. Naturally, this makes it challenging to set and exact start and end date for a Campaign Cycle. Client may request a pause in a Campaign. Client acknowledges that all statistics provided by Publishers evidencing such utilization shall be conclusive and binding on Client for all purposes of this Agreement.

Should Client ever receive a complaint from a consumer, governmental agency, or quasi-governmental agency for matters relating to our work as the Marketing Director, the Client shall immediately notify High 5 Promotions in writing.

We Do Not Work with Hostages

If you are unhappy, kindly provide 30-days notice of your intention to terminate the agreement. We ask for 30-days notice because we author content 60 to 90 days in advance. Access to all assets that were created will be sent via email.
